In conjunction with this new regulation, FOREX.com must discontinue metals trading for US residents on Friday, July 15, 2011 at the close of trading at 5pm ET. As a result, all open metals positions must be closed by July 15, 2011 at 5pm ET. We encourage you to wind down your trading activity in these products over the next month in anticipation of the new rule, as any open XAU or XAG positions that remain open prior to July 15, 2011 at approximately 5:00 pm ET will be automatically liquidated. So far we have only received this warning from Forex.com. We are waiting to see which other dealers inform their customers that trading gold and silver over the counter will soon be illegal.
It appears that Forex.com's interpretation of the law stems primarily from Section 742(a) of the Dodd-Frank act which "prohibits any person [which again includes companies]from entering into, or offering to enter into, a transaction in any commodity with a person that is not an eligible contract participant or an eligible commercial entity, on a leveraged or margined basis."

美國將禁金銀櫃檯交易 但或對金銀走勢影響不大

從7月15 日開始，美國將取締貴金屬場外交易，禁止美國公民從事金銀櫃檯交易，此舉將結束黃金白銀的高杠桿交易，減少金銀交易量，短期內對金銀價格有不利影響。《貨幣戰爭》作者宋鴻兵則認為，由於全球最大的金銀櫃檯交易在英國倫敦，因此，美國禁止金銀櫃檯交易對金銀走勢影響不大。 　
　
美國外匯交易商嘉盛集團旗下零售交易品牌Forex.com上週五收盤後向客戶發出重要通告，稱根據美國會頒布的多德-弗蘭克法案，7月15日之後，貴金屬場外交易的合法性將被取締。嘉盛集團稱，為遵守相關新規，將從美東時間7月15日下午5點起對美國居民停止貴金屬交易。相應的所有公開貴金屬持倉也將關閉。這意味著自該日期以後，美國居民在OTC市場交易黃金、白銀均將被視為違法。據了解，多德-弗蘭克金融改革法案是美國金融服務業改革的一部分，目的是加強金融監管，減少金融市場波動風險。
　　
美國取締金銀櫃檯交易在國內投資者中引起軒然大波，南京一投資者告訴記者，這個消息來得太突然，到底對金銀市場走勢有何影響還不清楚，考慮到最近金銀價格的波動性比較大，因此心裏有點恐慌。對此，宋鴻兵昨天在微博中認為，“對市場不會有明顯影響，金銀櫃檯交易最大市場在倫敦，美國法律管不著。”而且，雖然美國禁止本國人從事金銀櫃檯交易，但如果美國人參與倫敦金銀櫃檯交易，美國法律也限制不了，何況那些金融大鱷們不會以真實身份參與交易。

專家表示，美國取締貴金屬場外交易意味著金銀市場上外匯黃金白銀對衝交易中高杠桿交易即將結束，美國黃金白銀交易量會下降。短期內金價或隨著美國投資者金銀倉位的逐步結清而出現小幅下跌，但總體影響預計十分有限，期貨市場成交量可能會小幅提升。(陳春林)
