Nebraska Ends Income Taxes On Gold And Silver, Declares CBDC’s Are Not Lawful Money

www.zerohedge.com

Authroed by JP Cortez via the Mises Institute,

With Gov. Jim Pillen’s recent signature, Nebraska has become the 12th state to end capital gains taxes on sales of gold and silver.

LB 1317 is the fourth major sound money bill to become law this year, as state lawmakers across the nation scramble to protect the public from the ravages of inflation and runaway federal debt.

Under the new Nebraska law, any “gains” or “losses” on precious metal sales reported on federal income tax returns are backed out, thereby removing them from the calculation of a Nebraska taxpayer’s adjusted gross income (AGI).

Supported by the Sound Money Defense League, Money Metals Exchange, and in-state advocates, Nebraska’s sound money measure passed out of the unicameral legislature’s Revenue committee unanimously before being amended into a larger bill.

Sponsor Sen. Ben Hansen said upon news of the formal enactment of his legislation:

Gold and silver are the only forms of currency mentioned in our Constitution and with that comes the people’s ability to use it as such without penalty from the government. Saving, and using, gold and silver is our right and one of the only checks and balances to our federal government’s unending devaluation of our paper currency.

Taxpayers often realize ‘gains’ when converting the monetary metals back into Federal Reserve notes even though the ‘gains’ do not reflect an increase in real value but rather reflect the currency’s ongoing devaluation.

Despite the lack of “real” gains, the Internal Revenue Service imposes capital gains taxes on such transactions. Nebraska has now opted out at the state level, declining to carry the IRS’s position into the definition of Nebraska income.

Jp Cortez, executive director of the Sound Money Defense League, explained during his testimony before the Revenue Committee that the ferocious wave of inflation facing Nebraskans is largely caused by harmful actions of the Federal Reserve:

The state can take a different course and provide Nebraska citizens cleaner access to gold and silver ownership – and these metals are not only a proven inflation hedge but states all over the country are remonetizing constitutional sound money in the form of gold and silver.

Eleven other states already do not charge an income tax on sales of precious metals, with Arkansas, Arizona, and Utah recently enacting such laws. Meanwhile, Iowa, Georgia, Oklahoma, Missouri, West Virginia, and Kansas have been considering similar legislation in 2024.

“Investments in precious metals coins and bullion in Nebraska are now rightly exempt from both sales tax and income tax,” said Stefan Gleason, CEO of Money Metals and Chairman of the Sound Money Defense League.

Neutralizing Nebraska’s income tax treatment of the monetary metals removes significant disincentives in the Cornhusker State against the ownership and use of the monetary metals.

Meanwhile, LB 1317 revises the state’s formal definition of money by adding language that states: “Money does not include central bank digital currency.”

The new law defines central bank digital currency as “a digital medium of exchange, token, or monetary unit of account issued by the United States Federal Reserve System or any analogous federal agency that is made directly available to the consumer by such federal entities. Central bank digital currency (CBDC) includes a digital medium of exchange, token, or monetary unit of account so issued that is processed or validated directly by such federal entities.”

Sen. Hansen said: “I believe we have to be extra vigilant in our assessment and application of a Central bank digital currency to make sure they do not become a danger to our freedom. That’s why we defined in LB 1317 that CBDC’s are not classified as currency in Nebraska, which should help protect against unwarranted mandates for their use in the future.”

Versions of this “anti-CBDC language” have advanced or signed into law in Tennessee, North Carolina, and Florida, South Dakota, and Indiana . Congressman Alex Mooney has also introduced a federal measure to block the Federal Reserve’s digital currency scheme.

In his testimony, Cortez discussed the potential risks of adopting a CBDC, including creating a greater ability to track all financial transactions, disallowing certain types of purchases, or even completely “turning off” a targeted individual’s access to money.

Nebraska joins Utah, Wisconsin, and Kentucky as states to have enacted pro-sound money legislation into law so far in 2024.

Currently ranked 22nd in the 2024 Sound Money Index, Nebraska’s ranking is expected to rise.

Looming tax hikes are giving rich Americans 'heartburn' as they try to mitigate the hit

finance.yahoo.com

·Reporter

Wealthy Americans are scrambling to find the best way to minimize the hit from tax hikes in the Democrats’ reconciliation package moving through Congress.

Making it more difficult is the uncertainty surrounding the timing of certain hikes, especially the increase of the capital gains rate that could hit the wealthiest the hardest.

“That's giving clients a lot of heartburn,” Ryan Losi, a certified public accountant with Piascik, told Yahoo Money.

Earlier this month, the House Ways and Means Committee unveiled its plan proposing to increase the top long-term capital gains and qualified dividends tax rate to 25% from 20%. Additionally, the plan includes reverting the top individual income tax rate back to 39.6% and reducing the estate and gift tax exemption to $5.85 million from $11.7 million.

Taxpayers making above $1 million would see an 11% tax increase to their federal taxes under the House Ways and Means Committee plan, according to an estimate by the Joint Committee on taxation.

Most changes likely will get enacted next year, except the capital gains tax, which could be retroactive to September 13 of this year if the Senate keeps the provisions drafted by the House.

“We have been for months telling clients to consider their capital gains provision, whether it's selling of capital assets or investments or selling part of a business,” Lewis Taub, a certified public accountant and New York director of tax services at Berkowitz Pollack Brant Advisors, told Yahoo Money. “I've been working with clients on this for months, attempting to accelerate the gains.”

‘Take the freakin' cash’

Many wealthy individuals have been selling stock investments or businesses to escape the anticipated increase in the capital gains rate. Doing so may mean significant savings for wealthy individuals.

“It was pretty clear that capital gains rates would go up dramatically and I think that's capitulated a lot of sales or businesses,” Losi said. “I’ve had more activity in the past two years than I've had since maybe 2005-2006.”

The increase could have been worse. Biden’s initial plan called for raising the capital gains rate to 39.6% — versus the 25% that’s in the current proposal — giving the wealthy “some level of relief,” according to Taub.

While some investors may hold off on selling assets because they expect bigger gains down the road to offset the increase in the capital gains rate, others may not be able to wait.

‘You might want to take a larger bonus’

The Democrats’ plan also includes restoring the top individual income rate to 39.6% for taxable incomes above $400,000 from 37% enacted under the Trump administration. To avoid that hike that will likely start in 2022, high-income earners are accelerating income into 2021.

“It is prudent that if there is a way to accelerate income that was going to be included in 2022 to attempt to accelerate it into 2021,” Taub said. “You might want to take an additional salary, you might want to take a larger bonus if you think you're going to be in the higher rate next year.’

Individuals may also convert traditional IRAs to Roth IRAs or exercise stock options to pull forward income. Deferring deductions to 2022 also can lower taxable income for high net worth individuals, while business owners can invoice earlier to get that income in 2021 versus 2022.

‘A lot of value you can get out of your estate’

Democratic lawmakers also want to reduce the estate and gift tax exemption to $5.85 million from $11.7 million, subjecting more people to estate taxes starting next year. Transferring lifetime wealth before the end of 2021 could lead to a significant break for high-income earners.

Wealthy individuals are considering gifting assets before year-end or creating a trust to shield wealth from the estate tax. By doing so, an individual can still be the income beneficiary and use the cash flow from those assets that are invested, according to Losi.

“I’ve actually had more trusts set up in the past 18 months than I've had in a long time,” he said. “That's a lot of value you can get out of your estate and it's liquid wealth."

on.cc東網專訊

on.cc東網專訊

on.cc東網專訊

NOW財經

on.cc東網專訊

on.cc東網專訊

on.cc東網專訊

on.cc東網專訊

on.cc東網專訊

FATCA Going Worldwide

armstrongeconomics.com

At G20 last year, all governments agreed to report everyone everywhere to their host countries for tax purposes. The hunt for taxes is destroying the world economy at a staggering rapid pace and this is far worse than even I had anticipated when we first forecast BIG BANG would hit 2015.75 back in 1985.

Here is a email a non-US citizen received from his trust company in Malta.

“The reporting charges have arisen due to the implementation of new U.S legislation known as the Foreign Account Tax Compliance Act (“FATCA”) which has been introduced as part of a global initiative to create an International tax reporting regime. Together with the majority of the World’s major trading nations, the Maltese Government has entered into an agreement with the US Authorities to implement FATCA legislation in Malta. The legislation has required all Trust Companies in Malta to evaluate all structures operated on behalf of clients and categorise them according to detailed rules set out in the FATCA legislation. This categorisation process is not just limited to structures operated on behalf of US clients, or clients holding US assets but has to include all clients and structures irrespective of where clients and their structures are domiciled. We can advise you that has taken extensive legal and tax advice regarding the categorisation of clients and which information should be reported according to various trigger reporting events since our accounting and client management systems have to be tailored to supply relevant information on a per client and  entity basis to the Malta Authorities who then report directly to the IRS.

Consistent with many other Trust Companies a decision has been taken to pass on some of the costs of this work to client structures for whom we act. Accordingly a December invoice will be issued for a one off fee of £250 that will be described in the invoice as a FATCA classification fee.“

on.cc東網專訊
